Article 1 — Scope

These Terms and Conditions of Sale (“Terms”) apply to orders placed by consumers on www.budskateshop.com with BUD SKATESHOP, a French limited liability company with share capital of €155,000, registered with the Rouen Trade and Companies Register under number 790 034 128, whose registered office is at 10 rue Thouret, 76000 Rouen, France.

The Terms applicable to an order are those provided to the customer at the time the order is confirmed. BUD SKATESHOP may amend the Terms for future orders. Mandatory consumer protection laws take precedence over any conflicting provision.

Article 2 — Customers and products

Customers must have the legal capacity to enter into a contract or, where applicable, the consent of their legal representative.

The essential characteristics of products are described on their respective product pages. Product photographs and illustrations provide additional information, subject to screen display differences and any variations stated on the relevant product page.

Article 3 — Availability

Products are offered subject to availability. If an ordered item becomes unavailable, BUD SKATESHOP will notify the customer as soon as reasonably possible and offer a replacement product with the customer’s agreement or a refund of the unavailable item, as appropriate. No substitute product will be imposed.

Article 4 — Orders

Before confirming a purchase, the customer selects the products and reviews their order, contact details, delivery address, applicable charges and total price. By submitting an order with an obligation to pay, the customer accepts these Terms.

An order acknowledgement is sent by email. In cases involving a manifest error, suspected fraud or an objective inability to fulfil the order, BUD SKATESHOP will contact the customer and handle the order in accordance with applicable law. No additional delivery fee may be imposed after an order without the customer’s express agreement.

Customers are responsible for providing accurate information. Fraud prevention checks and any associated personal data processing are conducted in accordance with data protection laws.

Article 5 — Prices and taxes

Prices are shown in euros. Applicable taxes, calculated in particular according to the delivery destination, and shipping charges are displayed before the final order confirmation. For shipments outside the European Union or to certain territories, local import taxes, customs duties or other charges may be payable upon delivery under applicable local rules.

BUD SKATESHOP may change its prices at any time; the price payable is the price displayed and accepted when the order is confirmed. Ownership of the goods remains with BUD SKATESHOP until payment is received in full, without prejudice to the customer’s statutory rights.

Article 6 — Payment

Customers may use the payment methods available at checkout, including bank cards and PayPal where offered. Payments are processed by the payment service providers used by the website. Card details are handled through the secure systems of these providers.

Payment is due in accordance with the conditions shown at checkout. In the event of a declined payment or suspicious transaction, BUD SKATESHOP may place the order on hold while carrying out necessary checks, within the limits permitted by law.

Article 7 — Delivery

Available destinations, delivery methods and charges are displayed during checkout and on the Shipping costs page. Goods are delivered to the address supplied by the customer. The delivery period is the one communicated before the order is placed; where no period is given, Article L. 216-1 of the French Consumer Code applies.

Under Articles L. 216-2 et seq. of the French Consumer Code, the seller bears the risk of loss or damage until the customer or a designated third party physically takes possession of the goods, except where the customer arranges a carrier other than one offered by the seller.

If delivery is delayed, lost, damaged or incorrect, customers may contact [email protected] or +33 (0)2 32 08 66 60. Customers are encouraged to report visible damage and retain supporting evidence (photographs, packaging). Failure to make a reservation on delivery does not remove the customer’s statutory rights. In the event of non-delivery, customers may exercise the rights provided under Articles L. 216-6 et seq. of the French Consumer Code.

Article 8 — Withdrawal, returns and statutory warranties

Certain NIKE SB models, particularly Dunks (shipped without a double box to discourage resale), are excluded from this withdrawal policy due to the widespread circulation of counterfeits.

8.1 — Statutory right of withdrawal

Under Articles L. 221-18 et seq. of the French Consumer Code, consumers generally have 14 days from receiving the goods (or the final item in a split delivery) to notify their decision to withdraw from a distance sales contract, without giving a reason. Only the exceptions provided by law apply, including those listed in Article L. 221-28.

Customers may exercise this right by sending an unambiguous statement to [email protected] or by using the model withdrawal form below. Withdrawal through the website’s online interface must also be possible in accordance with Article L. 221-21 of the French Consumer Code.

Goods must be returned within 14 days of notifying the withdrawal. Direct return shipping costs are borne by the customer if the customer was informed of this beforehand, unless BUD SKATESHOP expressly agrees to cover them or the law provides otherwise. Customers may handle goods as necessary to establish their nature, characteristics and functioning; any reduction in value may only be charged where handling exceeds what is necessary, subject to statutory conditions. A withdrawal cannot be rejected solely because the original packaging has been opened.

BUD SKATESHOP will refund amounts due, including standard outbound shipping costs, no later than 14 days after being informed of the withdrawal. The refund may be withheld until the goods have been received or evidence of their return shipment has been provided, whichever occurs first. Refunds are generally made using the original payment method without fees to the customer. Additional delivery charges resulting from an express choice of premium shipping need not be refunded.

8.2 — Model withdrawal form

To: BUD SKATESHOP, 10 rue Thouret, 76000 Rouen, France — [email protected]

I hereby notify you of my withdrawal from the contract for the sale of the following goods: [description].
Order number: [number].
Ordered on: [date] / Received on: [date].
Consumer’s name and address: [details].
Date: [date].

8.3 — Statutory warranties

Independently of the right of withdrawal, goods are covered by the statutory guarantee of conformity under Articles L. 217-3 et seq. of the French Consumer Code and the guarantee against hidden defects under Articles 1641 et seq. of the French Civil Code. These statutory rights are not conditional upon keeping the original packaging or upon the existence of a commercial warranty.

Information concerning statutory warranties (summary of the notice required under Article D. 211-2 of the French Consumer Code):

Consumers have two years from delivery of the goods to request remedies under the statutory guarantee of conformity. During this period, they need only establish the existence of the lack of conformity, not the date when it arose.

Where goods include digital content or digital services supplied continuously under the contract for more than two years, the guarantee for those digital elements applies throughout the agreed supply period. Any necessary updates to maintain conformity must be provided.

Consumers are entitled to repair or replacement within 30 days of their request, without cost or major inconvenience. A repair extends the original guarantee by six months. If the consumer requests repair but the seller imposes replacement, a new two-year guarantee applies to the replacement.

Consumers may obtain a price reduction or terminate the contract with a refund against return of the goods in the circumstances set out by French law, including where the seller refuses a remedy, a remedy takes more than 30 days, causes major inconvenience or fails, or the lack of conformity is sufficiently serious. Termination is not available for a minor lack of conformity.

The guarantee is suspended while the goods are immobilised for repair or replacement. The statutory rights stem from Articles L. 217-1 to L. 217-32 of the French Consumer Code. Consumers also benefit from the statutory warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code, exercisable within two years of discovery of the defect, with remedies that may include a price reduction or a refund upon return of the goods.

For the full statutory notice in French, see the Annex to Article D. 211-2 of the French Consumer Code.

Article 9 — Applicable law and disputes

These Terms are governed by French law, without depriving consumers resident in another country of any mandatory protections applicable to them. In the event of a dispute, customers are encouraged to contact BUD SKATESHOP first at [email protected]. If an amicable solution cannot be reached, consumers retain the right to bring proceedings before courts having jurisdiction under applicable law. No exclusive jurisdiction clause is imposed by these Terms.

Article 10 — Personal data

Personal data needed to process and deliver orders, prevent fraud and provide after-sales assistance are processed in accordance with the General Data Protection Regulation (GDPR) and applicable French data protection legislation. Individuals may exercise their applicable rights, including access, rectification, erasure and objection, by contacting [email protected]. Further details of data processing, recipients and retention periods are provided in the website’s privacy policy.
